AT LAST!

Bonjour!
After 16 months,of process, I got a letter na maging french citizen na ako, yuhoooo!

By March 15, may- I- see ako sa court for signing and maybe what ever eks eks(etc etc) to do there.

Dati daw, sa cityhall lang. Ngayun before the judge na.
Siguro i- may- i -look ako kung ako ay naka talukbong na.

No ha? hihihihihi!

Anyway, na post ko sa facebook account ko about my soon-to-be-french.

Mag dual Citizen daw ba ako?

Before I jump to answer, hinanap ko ang batas about it.

Eto nagather ko;( Mahaba lang if not interested, skip it, scroll down na lang...)

CITIZENSHIP RETENTION AND RE-ACQUISITION

“REPUBLIC ACT NO. 9225”

Sec 1. SHORT TITLE — This Act shall be known as the "Citizenship Retention and Re-acquisition Act of 2003."

Sec 2. DECLARATION OF POLICY - It is hereby declared the policy of the State that all Philippine citizens who become citizens of another country shall be deemed not to have lost their Philippine citizenship under the conditions of this Act.

Sec 3. RETENTION OF PHILIPPINE CITIZENSHIP - Any provision of law to the contrary notwithstanding, natural-born citizens of the Philippines who have lost their Philippine citizenship by reason of their naturalization as citizens of a foreign country are hereby deemed to have re-acquired Philippine citizenship upon taking the following oath of allegiance to the Republic:

"I _________________, solemnly swear (or affirm) that I will support and defend the Constitution of the Republic of the Philippines and obey the laws and legal orders promulgated by the duly constituted authorities of the Philippines, and I hereby declare that I recognize and accept the supreme authority of the Philippines and will maintain true faith and allegiance thereto; and that I impose this obligation upon myself voluntarily without mental reservation or purpose of evasion."

Natural-born citizens of the Philippines who, after the effectivity of this Act, become citizens of a foreign country shall retain their Philippine citizenship upon taking the aforesaid oath.

Teka... teka... teka, it says;

"I hereby declare that I recognize and accept the supreme authority of the Philippines and will maintain true faith and allegiance thereto;"

Eh French na ako nun, then the true faith and allegiance ko -> sa Authority of the Philippines pa rin? How about my allegiance to France being French?

YAY!
Parang magulo ata ah?

Also how much is the cost of Retention of Philippine Nationality in your host country?
Here is it in Bureau of Immigration Website; Sa Pinas yan ha...

How does my two countries benefit from me besides a "nuissance" to both? (wink)
Is dual citizen worth taking?
Travel tax exemptions?

I have the same reservations as you do. To me full "allegiance" cannot be divided. I also have a problem with the words "supreme authority." Anyway, issues I personally need to resolve. :)

I'm not sure of what benefit dual citizenship will be to me; if I travel abroad with a Philippine passport I need visas for practically everywhere but for my US passport I don't. Maybe for sentimental reasons, yes, but it may cause problems for my husband and son who are in the US military. As far as benefit for the Philippines? All I can see is (and I agree with you) that PI receives revenues for the processing and application fees.

As I mentioned in fb, I worry about double-taxation and I don't mean travel tax - I meant income tax. I'm not a Philippine tax agent so I don't know, do I have to pay Philippine Income Tax too if I apply to gain back my Filipino citizen?

Until I see a personal value I think I will be on a wait-and-see mode; and I've been on this mode since 2003 when I heard of the "new" law. :)

Good luck and again, am so happy for you that you are finally going to have what you've been wanting.
Bravo, plain jane, this is a very important decision and giving full allegiance to Philippine govt by oath tking and signature will mean that your US citizenship is second priority.I think your Philippine country is taking filipinos a ride.
for a ride, i mean, type error!
Advantages of Filipino citizenship:
1. You can vote - to others, don't care about this.
2. You can own real properties (house + lot) for investments also.
3. You can own and operate a business - maybe put up McDonalds.
4. You can practice your profession, if you're a doctor you can treat patients here also.
5. You can reside in the Phil. for any significant amount of time (also come and go, avoiding entry fees and exit clearances). Foreigner can only stay 21 days + renewal 38 day, then 2 months extension ($100 per extension) up to max of 1 year. Unless may tatak "balikbayan" at immigration when you come in enables you to stay 1 year.

If you think any of these do not apply to you then you might as well save about $300 in fees.
Congrats Francesca, with your upcoming French citizenship.
I think that if you don't plan to vote or own property in the Philippines you don't need even to bother retaining your Philippine passport.Visiting the Philippines is no problem, you're "balikbayan" upon arrival, and the stamp is good for a year - much longer than you would probably stay in the Philippines.
Don't worry, being a Filipina is something in your heart, no piece of paper can give it to you, and none can take it away.
I'm a Dutch citizen since 1994, and I regained my Philippine passport in 2003, but this is because I want to vote in Philippine elections. But that's just me.
Congratulations po Ate! I agree with Carlo. Ang pagiging Filipino ay nasa puso!
plain jane, korek, wait and see mode muna, malay tatakbo akong congreswoman, tatalunin ko si mme gma, lol (joke).Pero Lolo noticed your reasonings, he said, that comments comes from a a plain jane?

lolo ang kulet!

anonymous 1, we try to be reasonable here, so please be one.

Anonymous 2, Thank you! May advantage din pala, if yun na nga ang status ko ayun sa mga naisaad mo.

I live in Nice, France, 900kms from Paris Phil Embassy. If I apply for dual,I pay roughly 250€ procees fees, plus plane tickets roughly 200€ round trip, plus hotel and resto for oath taking. Hays.
Kadako gastos!

Thanks for writing about your concerns regarding the dual citizenship kasi I was thinking about it too although more years pa bago ako makapg apply ng ctizenship ko. Mabuti na yang napag-iisipan habang mas maaga. =) Congrats ulet!
congratulations!! the processing there seems a lot faster than here, after my visit at the police nationale, no news whatsoever from them. but anyway, it's not really in my priority list.

i think i'll take the dual nationality. just for the possibility of investing in the phils. i still plan to retire there.
