INSPECTION DE TRAVAIL

This is a government office taking care of working conditions of employees in Monaco. I was with husband Michel.Monday Dec 1 was our first visit since I work in Monaco year 2000.Even Michel didnt know that office existed in Monaco. I knew because my coffeemates told me to go see them.
The lady is very strong in character, she must be a lawyer or the head Counsellier, the way she speaks, she is not the person you can make a joke with.
Even Michel behaved.Not the moment to get excited ey?
She asked me some documents.
Payslip, work contract, termination letter,Work Certificate, sickleave forms, sss id, resident card.
She took a computer file of my Boss when hiring me.
It was all in her computer,as legally hired, good enough.
After figuring out what happened, she said;
-This is not right, this is not right,would you like me to call your Boss?
-Yes, please.
She looked into the details of the Boss, and dial the house phone.
-Sir, bonjour, its the inspection de travail calling. I would like you to know there are some errors in terminating the contract of your employee blah... blah... yadah... yadah...
(And she goes on and on, that the Boss cannot butt in.Eventually, (as far as I understand),the Boss promised to correct the matter, and will inform me of the revised papers and more checks...)
The lady then told me to contest within two months, the termination letter to Monaco court.
1.Then she explained,I will get another month salary, as the Boss can sack me only on December 29 onwards.Meron daw pre avis(advance notice) na one month.
2.Plus 25 days HOLIDAY pay from March 2008 to December 2008.
3.Plus indemnity money because of terminatiing my contract, my contract is long term. The accountant will do the computations,because it depends how many hours I do in a month.On attend, we wait daw.
4.She explained more benefits which I cannot keep up because she speaks in speedy gonzales french.
Whewhhh....
Michel and I cant believe the outcome. Two months salary more++....We thank the lady and next week is another appointment with her to see if the Boss comply with all the paperworks.
Ahhh, it was a relief to be sack after all.
I dont need to find a new employer now. I just relax at home and count my blessings.

PS; if the Boss was told off by the LABOR OFFICE, Im sure he would be very upset.The call disturbed his going to play golf.

I think it's actually a blessing that this happened. You can better focus on your health and your family and at the same time not worry about finances, di ba? It all works out.

It's the law if they terminate you without valid reason they will need to pay the damages.
I think you need to rest a lot before looking for a job! Anyway health is the most important because it serves as your capital when finding another one ;) !

Amy, European labor laws are pro employee - a dream in fact for employees all over the world! It is almost unthinkable here in Europe to resign from your job without another job waiting. People would fight to be sacked than resign. Why? Its all about the benefits.
France in fact has the most toughest labor laws in Europe - in an article I read a while back, people have grown roots under their chairs sticking to the positions they currently for YEARS even if they have not performed because by law, employers cannot just fire permanent employees.
Same here in the Netherlands, if my employer want to fire me (I have permanent conract), they will have to build a case and submit to the Labor for approval. If approved, Labor (or the government's social benefits) will pay 70% of my last earned salary every month, usually for the next 6 months to 2 years depending on my work tenure. If after 2 years I don't still have a new job, I go to a different pot - lesser social benefits pay, not sure, perhaps 50% of my last earned salary.
At any rate, you are on the right track. I hope you did not signed (or agreed) to the termination because if you do this will deny you from the social benefits. Voluntary or mutual agreement termination = 0 benefits.

the thing is, i resigned by force, so i complained to labor office, and they saw the loophole. im on sickleave and the reason that i damage daw some of his things, i have to contest that in court with back up of labor office.
but if former boss will give me 4months salary, i keep quiet. nasa akin naman if i file a case or not.
In France, they are now starting the Prudhommes, it is same agency like inspection de travail in monaco.They elect officers yesterday.Sa dami na layoff due to the crash, french people are angry.
Kawawa nga mga employers dito, bec they declare and pay 46percent monthly salary on top to the govt for eah employee's social benefits.
Then,talo pa sila sa taxes, kaya they minimize manpower.
Not like in shopping malls in phils, i saw a lot of cashiers in one booth, when in france, the cashier is also the sale personnel.
except on big groceries
my afternoon employer keeps me.she was annoyed also I was absent for 40 days, but she said, she appreciate my work and she will keep me. I also have long term conract with her, and despite half day work, 80 hours a month, im still covered with full sss benefits under monaco labor law.
she gave me a month advance salary bec until now SSS do not yet pay me.
the only thing im not happy at the lost of morning work is my retirement points.
but if former boss will give me 4months salary, i keep quiet. nasa akin naman if i file a case or not.

I'm sorry to hear of what happened with the boss with butler. I haven't read the whole episode but at least it's good to know that your labor rights have been protected. Grabe naman pala yang si butler. Relax ka lang muna and enjoy your paid vacation. Get well soon

Buti naman at positive ang outcome ng pagpunta mo sa labor office. It is definitely not allowed to fire someone just because they were on sick leave. This is unlawful. You deserve justice.

yeah, that's what i thought, you're entitled to more benefits than what the boss gave.. but didnt know the law in monaco, so i shut my mouth, lol.. here in france, i paid indemnities, congés payés when we terminated our nanny's contract.. good thing you went to the labor office to stand for your right.. rest muna before searching for a new job.. anyway, xmas season na, so shopping ka na lang muna, lol.

no siya, bayad muna siya then tapos tapos na kami.
