Ayala wrote me back my email and their answer. They still didnt give me back the discounts. The answers to my email is in Italic font.
This my letter to them:
Dear Ms (Sales Manager)
My complain is:
First we discuss with Atty Pulido before we signed the contract, we avail of 2% disc( 43,093.06)+ 20,000 August promo,+ 5% discount (25,144.50)because we opt to give one spot deposits of 477,116.72 pesos - we already discussed. and thank you for understanding.
You signed ( we got the copy) that, that computations will be on the blank contract.
After an hour, the pricing and some discounts disappear. Right after we signed the contracts.
You admit that you all made a mistake. yes,confussion arises if we are going to loan from the bank or have it cash or loan thru UK bank. right?
Another computation arises:
You delete the 2% disc, then the 5% spot down disc is deleted also and whats left is employee discounts of peanuts(41,546.53 ) when we are about to send this amount of 536,408.55 in a month (August 30, 2005)?

Please focused on the official computations that i gave you before you leave the country there's no 536,408.55 as agreed upon our last conversation. Your Spot Downpayment is only 477,116.72 Mam, this is the official coming from our sales admin is payable this Aug.
Are you all serious of the business or what? we cant blame you if we lead to this situation, sorry po.
I need an explanations on this, Frenchman is total mad about this, and told me to hold sending the downpayments. We will be opting to cancel the whole lot if it is like that!

It's so disappointing talaga. Diba nila naisip that good business reap good rewards? Obviously not! If your purchase had been successful it would've been a very good way to advertise their business more to your other expat friends. Sinayang kamo nila!
Bakit naman kasi si Ayala hindi black and white sa deal nya? Thats also what I noticed in doing business in the Philippines (been in sales for 10 years there engaged in software enterprise applications dati) and its always the case, nothing is black and white, always maraming grey areas. This is very typical Pinoy business dealings. Hindi kasi pwede yan eh sa mga foreigners at mga taong exposed na sa culture na black and white. And usapan ay usapan, magkamali ka dyan, they will not trust u anymore. Pera yan kasi.

He noticed kasi one time I was traveling to a friend and my friend (Pinay haha) changed my schedule with her last minute to something else. Bakit raw ganun? Bakit raw ako pumayag? Simple lang dapat ang explanation ng sales department, kaya kahit sila nahilo!
so bigay na raw nila lahat na discounts. But, uutangin ko raw 1.7 million pesos na balance sa bank nila, with interests of 12 per year.
Tinotal ko interests: 206 thousand pesos ++ barya.
X2 kaya tutubo bank sa kin ng kulang kulang 412,000 pesos sa 24 months payments.

sabi na sayo e, check their interest rate..i was surprised talaga when you told me it's 0%int for 2 yrs. they actually prefer inhouse financing kasi they gain a lot from the interest alone, pag cash payments kasi, walang ganun, and what will they do with cash, e laki na ng capital nila right...hehe, and what? you're obliged to loan from their bank? hehe, business à la pinoy talaga oo...

mortgage in pinas is never advisable. if pwede pa i-mortgage sa labas, yan advisable. ang problema kasi sa pinas sobrang taas ng inflation kaya interest rates taas rin [one of the highest kamo in the world, yata].

Madame, Thanks for posting your experience with real estate buying in Pinas, I learned alot.
I hope you will soon get your money back and get them out of your hair. They wasted 3 days of your vacation and is wasting more of your time.

I must admit, I gave you a different computation and I failed to initially expound on each one. As humans we are bound to commit mistakes, and I thanked you for that. From there, you made a final decision that everything will be ok. And now, you decided to decline what has been offered and agreed.
Is there anything that I can still do to make amends?
It saddened me though, but if this is really what you want, I just have to accept that the service I thought I was able to share with you, is now being dismissed. I really can't do anything about it since it is your decision. Yes, I will ask the Sales Admin to retrieve your checks form the Deutch Bank - (our safekeeping bank), and once I have them , I will return them thru your lawyer.
With regards to the reservation fee, however, it is the policy of the company, that it is non-refundable. I believe Atty. Pulido is aware of this, before we arranged for the reservation, she asked us to FAX all the details of the documents that you are going to sign it. it states there that payment of reservation fee of Php 20,000.00. Is non-refundable. Should you have any questions please feel free to ask.
