Annulment in Philippines

I got emails from some newbies in the Asawa forum asking me about annulment.
One ask how is the judge that handled my case as she got the same Judge that granted my annulment.
He he.

She is a correct judge.
Try to bribe her, she will put you to jail.LOL

My lawyer , her frist time to encounter a judge that is sooo organized in her court.
Got time to handle 15 cases in 4 hours from 8am to 12 noon.
Kaya nyo yon pag kayo Judge?
Then her decision, is within Three months after the last hearing.
According yan sa time allowed to them by the Supreme court to decide.
All files are well arranged.

Mine was exactly 2months and 28 days, when she decides the annulment in my favor.
Of course, who else? he he he

How is it in the court during hearings?

All case to be heared will be called.
Lawyers of both parties must acknowledge "ready" to the court clerk.
Then judge start with the prayer, then she bangs her gravel: court now in session.
Tatawagin ang first case: Mrs .... VS Mr ..., case number, Nullity of Marriage Case.
Then judge will ask, if both counsel present,
the petitioner,
the respondent.
Pag hindi ready ang lawyer, then nag sabi before na ready siya to show evidence, nagagalit ang judge.Kasi wasting her time.
Dapat umuwi na ang lawyer kanina pa, hindi naman pala ready! lol

Then kung wala ang respondent, hahanapin ng Judge ang acknowledgement summons by registered mail if the respondent was notified, and the respondent signed the summons.
If no signature of the respondent, hindi pwede mag proceed ang case.
Papadalhan uli ng summons, pagagalitan ang counsel for respondent, bakit hindi inaasikaso ang respondent, lalaban pala sa kaso, hindi pumirma sa summons, kung alam niya na may case against him or not.
Kung may pirma, proceed ang case, basta may pirma si respondent na alam niya may case sa kanya, ayaw niya lang umatend.


Ang lahat ng case to be heard for the day, nakapaskel sa labas ng pinto ng court.
Doon malalaman kung sino ang mag aaway sa court for the day.LOL
Yong name namin ni Ex naka paskel during hearing dates!

May comedy, may cry cry, may nakakasuyang mga testimonya.
Yong case ko, naaaliw ang judge.
Para raw tele nobela.
Eh ang lola nyo, okey sa komedya, at tele nobela kung mag kwento sa judge ng nangyari sa first marriage ko.

But!
hindi ako in public nag testify ha?
Sosyal ako.
Sa Chamber room ni Judge ako nag labas ng sama ng loob ko.
Requested by my lawyer.
After all, my case is a family dispute, pwede i discreet hearing na lang.
Wala si Ex, kaya okey lang kay Judge.

Mga tanong ng judge to huli me of my intention to file nullity of my marriage:

May balak ka ba mag asawa, kaya ka nag file ng annulment?
No, your honor.
In love ka ba?
I wish, your honor.
May nanliligaw sa iyo?
Yes your honor.
Ilan ?
Three your honor.
Pinoy or foreigners?
Foriegners, your honor.

Judge to anybody in the room:
Why foriegners like Filipinas?

Me: Because they like our color and values, I think your honor...

Judge: Tawagin si Fiscal, if he wants to cross examine the petitioner.
Sagot ni court clerk, no raw , your honor.
(Si fiscal, nag yoyosi sa labas! lol)

So the judge, declared my hearing finish, set a date for my lawyer to submit all exhibits, and within 3 months she will decide.
Uwi na kami.
Nabunutan ako ng tinik.
Natapos din ang Q and A namin ni lawyer in front of the judge.
HIntay na lang decision.

Yan ang hassles ng annulment.
Madali, mag pasakal, eheste pakasal.
Mahirap kumalas!
Laki laki pa gastos!
Time and money ha!
I paid total costs 130thousand pesos, 4 gives in one year time.
I won because of my grounds after a year process.
I was lucky.

lucky you! 3 months lang ang waiting mo, my friend - she waited for almost two years to finally have their marriage annulled.
Amy, yeah it is good that you are there to readily help the newbies in the annulment process, even by just recommending to them your lawyer or sharing your past experiences.

By the way, read your thread below (yun natabunan na) regarding coming to Amsterdam. I posted there many places you have to see. I know marami yun, pero many of them are within the centrum and is either walking or tram distance lang sya.

Dutchman is still in UK (guernsey islands) for work right now but will be back tomorrow evening. We supposedly plan to go somewhere kaso pagod na syang mag impake lol. I understand din naman, so we will just visit Maastricht, a beautiful city in the south of Holland near the Belgium border. Its a different city, the lifestyle is more laid back. We will be spending the whole Sunday there and Monday will be with the family (in laws).
Taga Dubai, my annulment ran 11 months, from date of filing to date decided.
Kaya matagal din.
Baka ganon din ang sa friend mo.
Depende rin kasi sa lawyer yan, kung pursigido or what.
Lawyer ko, got a lot to handle, kaya she haggles all schedules to take. Sometimes she asked the judge three hearign date extra, in case raw may anomalya sa dates like nagkasakit ang court clerk, or nag sit down strike ang mga employees, or may coup d etat, alam nyo na anyhting can happen sa Pinas, Manila pa.
Kaya siguro ang cases tumayagal kasi ang lwayer, hindi aresgado (makulit) sa hearing dates.
Anyway, ask kayo whatever about annulment, baka kaya ko.
Today one Pinay (, when she learned I have my annulment granted:) Asked me:
Bakit, may annulment na ba sa Pinas? Sagot ng isa: Na uso yan nong panahon ni sharon at gabby!

Marami pa nga ang hindi nakakaalam na annulment exist in Phils.
Bata pa lola nyo, may annulment na sa Pinas, ano ba kayo?!

Hi! I learned a lot from you're blog. Thanks to your tips, you're so lucky na-approve na annullment mo. Can you give us referral dun sa attorney who handled your case. Glad to have found your blog...I was just googling Annulment Hearings in the Philippines and saw yours...

My annulment is taking AGES! and I do have do agree..it does depend on the lawyer.

I have my hearing tomorrow...Hopefully this time eh kumpleto na sila at walang traffic!

Last Nov 07 all my 3 trial dates na-move ngayong Feb 08 dahil sa mga walang kwentang dahilan...Nag LBM ang lawyer ko, Na traffic si Fiscal...At lack of time! susme naman kasi...40 kaso sa isang araw!

Ako na nga nagmamakawa sa mga court clerk...igitna nman ako wag nman laging 38! hehehehe
